Gadens has successfully represented GC1st Pty Ltd (GC1st) in securing approval for a purpose-built student accommodation development to service the Southern Cross University Gold Coast Campus.
While the City of Gold Coast Council initially refused the application, a collaborative approach between the experts and the project team, and a series of minor changes to the design, secured Council’s support for approval. This outcome highlights the value of strategic engagement and technical expertise in navigating complex planning challenges.
The Queensland Planning and Environment Court allowed the appeal, overturning Council’s original refusal and paving the way for the project to proceed. Despite ongoing opposition from co-respondents, including local residents, on grounds of density and community expectations, the Court determined that the proposed density was appropriate for its context and confirmed the development would not result in unacceptable impacts.
This decision represents a major milestone for purpose-built student accommodation on the Gold Coast, helping to meet growing demand for accommodation and affordable housing choices for students.
The Gadens team acting for GC1st was led by Real Estate and Construction partner Gerard Timbs, with support from lawyer Angus Halligan. The team delivered strategic advice throughout the appeal, navigating complex planning issues and successfully demonstrating that the proposed height uplift was essential to delivering purpose-built student accommodation to meet the identified demand.
Commenting on the decision, Gerard Timbs said: “This is a significant outcome for GC1st and for the Gold Coast community. The approval will deliver much needed accommodation options and reflects the importance of well-planned developments that support education and growth in the region.”
